{"id":12005,"date":"2017-10-25T09:00:06","date_gmt":"2017-10-25T07:00:06","guid":{"rendered":"https:\/\/www.johner-institut.de\/blog\/?p=12005"},"modified":"2024-12-16T15:30:28","modified_gmt":"2024-12-16T14:30:28","slug":"legacy-software","status":"publish","type":"post","link":"https:\/\/www.johner-institut.de\/blog\/iec-62304-medizinische-software\/legacy-software\/","title":{"rendered":"Legacy Software: Forderungen der IEC 62304"},"content":{"rendered":"\n<div class=\"blog-column\"><strong>Legacy Software<\/strong> definiert die <a href=\"https:\/\/www.johner-institut.de\/blog\/category\/iec-62304-medizinische-software\/\">IEC 62304<\/a> in deren neuen Ammendment&nbsp;I als Software (Teil eines Medizinprodukts oder eigenst\u00e4ndige Software), die zum damaligen Zeitpunkt legal in Verkehr gebracht wurde, aber heutigen Anforderungen (insbesondere der IEC 62304) nicht mehr gen\u00fcgt.<\/div>\n\n\n\n<p><span style=\"background-color: yellow;\">Update<\/span>: <a href=\"https:\/\/www.johner-institut.de\/blog\/iec-62304-medizinische-software\/legacy-software#soup\">Abgrenzung von Legacy Software, SOUP und OTS<\/a><br><\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\" id=\"beispiele\">Beispiel f\u00fcr Legacy Software<\/h2>\n\n\n\n<p>Wenn Sie ein Medizinprodukt vor M\u00e4rz 2010 in Verkehr gebracht haben, mussten Sie&nbsp;die IEC 62304 noch nicht befolgen. Die Inverkehrbringung war legal, auch wenn Sie die Forderungen der Norm noch nicht erf\u00fcllt haben.<\/p>\n\n\n\n<p>Ein erstmaliges Inverkehrbringung einer Software nach dem M\u00e4rz 2010, die die Anforderungen der IEC 62304 nicht erf\u00fcllt, w\u00e4re hingegen keine legale gewesen, d.h. diese Software ist <strong>nicht<\/strong> als Legacy Software zu betrachten.<\/p>\n\n\n\n<p>Software die erstmalig vor M\u00e4rz 2010 in Verkehr gebracht wurde, die jedoch ge\u00e4ndert wurde\/wird und\/oder in einem anderen Kontext eingesetzt wird, f\u00e4llt wiederum&nbsp;unter die Definition des Begriffs \u201eLegacy Software\u201c. Allerdings unterscheiden sich die regulatorischen Anforderungen.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized alignnone wp-image-12008 size-medium\"><a href=\"https:\/\/www.johner-institut.de\/blog\/wp-content\/uploads\/2024\/12\/legacy-software-scaled.jpg\" data-rel=\"lightbox-image-0\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"2272\" src=\"https:\/\/www.johner-institut.de\/blog\/wp-content\/uploads\/2024\/12\/legacy-software-scaled.jpg\" alt=\"Legacy Software: Damals legal, heute nicht mehr IEC 62304 konform\" class=\"wp-image-5380326\" style=\"aspect-ratio:1;object-fit:cover;width:200px\" srcset=\"https:\/\/www.johner-institut.de\/blog\/wp-content\/uploads\/2024\/12\/legacy-software-scaled.jpg 2560w, https:\/\/www.johner-institut.de\/blog\/wp-content\/uploads\/2024\/12\/legacy-software-300x266.jpg 300w, https:\/\/www.johner-institut.de\/blog\/wp-content\/uploads\/2024\/12\/legacy-software-1024x909.jpg 1024w, https:\/\/www.johner-institut.de\/blog\/wp-content\/uploads\/2024\/12\/legacy-software-768x682.jpg 768w, https:\/\/www.johner-institut.de\/blog\/wp-content\/uploads\/2024\/12\/legacy-software-1536x1363.jpg 1536w, https:\/\/www.johner-institut.de\/blog\/wp-content\/uploads\/2024\/12\/legacy-software-2048x1818.jpg 2048w\" sizes=\"auto, (max-width: 2560px) 100vw, 2560px\" \/><\/a><figcaption class=\"wp-element-caption\">Legacy Software: Die S\u00fcnden der Vergangenheit (<a href=\"https:\/\/upload.wikimedia.org\/wikipedia\/commons\/9\/99\/DEC_VT100_terminal.jpg\" data-rel=\"lightbox-image-1\" data-rl_title=\"\" data-rl_caption=\"\" title=\"\">Bildquelle<\/a>)<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"regularien\">Regulatorische Anforderungen an Legacy Software<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Ziel des Ammendments I mit Bezug zur Legacy Software<\/h3>\n\n\n\n<p>Das neue Ammendment I zur IEC 62304&nbsp;bzw. die neue Version der IEC 62304 haben das Ziel, klare Vorgaben f\u00fcr die Legacy Software zu machen und dabei einerseits die regulatorischen Anforderungen nicht zu Lasten der Patientensicherheit aufzuweichen und andererseits den Herstellern einen realistischen Weg in die Legalit\u00e4t zu erm\u00f6glichen.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konzept des Ammendments I bzw. der \u00fcberarbeitenden Version<\/h3>\n\n\n\n<p>Die Idee hinter der \u00c4nderung der IEC 62304 mit Bezug zur Legacy Software ist die folgende:<\/p>\n\n\n\n<p>Das Risikomanagement soll dar\u00fcber entscheiden, ob es akzeptabel ist, Legacy Software<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>unver\u00e4ndert weiter zu verwenden,<\/li>\n\n\n\n<li>in anderem Kontext zu verwenden,<\/li>\n\n\n\n<li>zu \u00e4ndern und weiter zu verwenden.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Kapitel 4.4 der IEC 62304:2015 &#8222;in a nutshell&#8220;<\/h3>\n\n\n\n<p>F\u00fcr Legacy Software fordert die IEC 62304 ein Risikomanagement (Kapitel 4.4.2). Anhand der Ergebnisse daraus und aus Analyse der Post-Market-Daten entscheiden Sie, welche Schritte des normalen Entwicklungsprozesses Sie nachholen wollen (Kapitel 4.4.3).<\/p>\n\n\n\n<p>Ggf. kommen Sie zum Ergebnis, dass es kein inakzeptables Risiko gibt. Dann m\u00fcssen Sie gar nichts mehr machen, au\u00dfer Ihre Entscheidung zu begr\u00fcnden (Kapitel 4.4.5). Die Begr\u00fcndung ben\u00f6tigen Sie allerdings immer. Wenn Sie zum Ergebnis kommen, dass etwas nachgeholt werden muss, dann machen Sie das (Kapitel 4.4.4).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Voraussetzungen<\/h3>\n\n\n\n<p>Die Voraussetzung daf\u00fcr, dass Sie das Kapitel 4.4 anwenden d\u00fcrfen, besteht darin, dass Ihre Software \u00fcberhaupt Legacy Software ist. Die Tatsache, dass die Software &#8222;alt&#8220; bzw. nicht dokumentiert ist, reicht nicht aus. Die Software muss legal in Verkehr gebracht worden sein (s.o.). Legacy-Software darf auch nicht mit Komponenten oder OTS bzw. verwechselt werden. Mehr dazu lesen Sie weiter unten.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konkrete Forderungen an den Einsatz von Legacy Software<\/h3>\n\n\n\n<p>Die erste konkrete Forderung, n\u00e4mlich die nach einer <strong>pr\u00e4zisen <a href=\"https:\/\/www.johner-institut.de\/blog\/tag\/risikoanalyse\">Risikobetrachtung<\/a><\/strong>, wurde bereits erw\u00e4hnt. Das bedingt nat\u00fcrlich, dass Sie die <strong>Daten aus der Marktbeobachtung<\/strong> gesammelt und analysiert haben.<\/p>\n\n\n\n<p>Speziell bei \u00c4nderungen m\u00fcssen die Hersteller zus\u00e4tzlich eine <strong>Gap-Analyse<\/strong> anstellen, die die \u00c4nderungen kenntlich macht und m\u00f6gliche Auswirkungen\/Risiken untersucht.<\/p>\n\n\n\n<p>Solch eine Analyse ohne eine pr\u00e4zise Software-Architektur zu erstellen, halte ich f\u00fcr schwerlich m\u00f6glich \u2013 es sei denn, die ganze Software ist unkritisch.<\/p>\n\n\n\n<p>Aber dann h\u00e4tte man es wahrscheinlich eh mit einer Software der Sicherheitsklasse A zu tun. Damit w\u00fcrde die Dokumentation der Entwicklung auf die Software-Anforderungen und die Software-Freigabe zusammenschrumpfen. In anderen Worten: man w\u00e4re schon fast normenkonform, und das Thema \u201eLegacy Software\u201c w\u00e4re erledigt.<\/p>\n\n\n\n<div class=\"defbox\">\n<div class=\"definition\"><i class=\"fa fa-exclamation-triangle\"><\/i> Vorsicht!<\/div>\n<p>Ab Ammendment I bzw. IEC 62304:2015 sind&nbsp;auch f\u00fcr&nbsp;Klasse A Software &nbsp;<strong><a href=\"https:\/\/www.johner-institut.de\/blog\/iec-62304-medizinische-software\/software-systemtest\/\">Software-System-Tests<\/a> <\/strong>verlangt! Das war vorher erst ab Klasse B vorgeschrieben.<\/p>\n<\/div>\n\n\n\n<p>Wenn die Software ge\u00e4ndert werden soll, verlangt die IEC 62304, dass <strong>konform mit dem Wartungsprozess gem\u00e4\u00df Kapitel 6<\/strong> vorgegangen wird. Doch worin besteht dann noch die Erleichterung? Schlie\u00dflich verlangt dieser Prozess \u2013 abh\u00e4ngig von der Sicherheitsklasse \u2013 ebenso eine Architektur, ein Design sowie Tests der verschiedenen Stufen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"soup\">Legacy Software versus SOUP versus OTS<\/h2>\n\n\n\n<p>Legacy Software bezieht sich definitionsgem\u00e4\u00df auf die gesamte \u201emedizinische Software\u201c, d.h. auf ein vollst\u00e4ndiges Software-System. Wenn Ihnen die o.g. Erleichterungen nicht wirklich weiterhelfen, dann k\u00f6nnen Sie noch in Betracht ziehen, einen Teil Ihrer Software, genauer gesagt einen Teil Ihres Software-Systems, als <a href=\"https:\/\/www.johner-institut.de\/blog\/fda\/off-the-shelf-software-ots-versus-soup\/\">SOUP<\/a> zu deklarieren.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><th>&nbsp;<\/th><th>Legacy Software<\/th><th>SOUP<\/th><th>OTS<\/th><\/tr><tr><td>Teil eines&nbsp;Medizinprodukts oder Medizinprodukt selbst?<\/td><td>Ja<\/td><td>Ja<\/td><td>Ja oder nein<\/td><\/tr><tr><td>Ganzes Software-System?<\/td><td>Ja<\/td><td>Nein<\/td><td>Nein<\/td><\/tr><tr><td>Muss legal (mit Bezug auf EU-Richtlinien) in Verkehr gebracht worden sein?<\/td><td>Ja<\/td><td>Nein<\/td><td>Nein<\/td><\/tr><tr><td>Hersteller darf \u00c4nderungen daran durchf\u00fchren?<\/td><td>Ja mit Auflagen<\/td><td>Ja<\/td><td>Nein<\/td><\/tr><tr><td>Muss \u00f6ffentlich verf\u00fcgbar sein?<\/td><td>Nein<\/td><td>Nein<\/td><td>Ja<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>F\u00fcr die SOUP ben\u00f6tigen Sie definitionsgem\u00e4\u00df keine Aufzeichnungen deren Entwicklung betreffend, sondern nur<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>die Anforderungen an die SOUP<\/li>\n\n\n\n<li>die Voraussetzungen, von denen die SOUP ausgehen kann<\/li>\n\n\n\n<li>die klare Identifizierung der SOUP und<\/li>\n\n\n\n<li>eine kontinuierliche \u00dcberwachung und Bewertung der Marktdaten, Bug-Reports oder Release Notes auf Sicherheitsrelevanz<\/li>\n<\/ul>\n\n\n\n<p>Wenn Sie noch Last mit Ihren Altlasten haben, dann melden Sie sich.
